Agreement to Terms

These Terms and Conditions (“Terms”) govern your access to and use of the BuildersTogether LLC website, marketplace, services, and applications (collectively, “Services”). By creating an account, accessing, or using the Services you agree to be bound by these Terms, our Privacy Policy, and any other policies posted on the site. If you do not agree, do not use the Services.

About BuildersTogether

BuildersTogether LLC (“BuildersTogether”, “we”, “us”, or “our”) operates a C2C marketplace that connects sellers and buyers of recycled construction and demolition (C&D) materials. Our mission is to reduce waste by enabling reuse and resale of building materials.

Eligibility

You must be at least 18 years old to use the Services. By using the Services you represent and warrant that you are legally capable of entering into binding contracts. We do not knowingly permit persons under 16 to create accounts.

Account Registration and Security

  • Account creation: Users may register as buyers or sellers. Both must agree to these Terms when creating an account.
  • Verification: Sellers can create accounts and start selling immediately. We may verify seller identities and businesses and grant a verified badge after review.
  • Credentials: You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
  • Termination: We may suspend or terminate accounts for policy violations or suspicious activity.

User Conduct and Obligations

  • Lawful use: You agree to use the Services in compliance with applicable laws and these Terms.
  • Accurate information: Provide accurate, current, and complete information when registering, listing products, or interacting with users.
  • Prohibited conduct: Do not post illegal items, hazardous materials without proper disclosures, stolen goods, or listings that infringe intellectual property rights. Do not harass, defraud, threaten, or impersonate other users.
  • Communications: Buyers and sellers may communicate through our messaging system. Admins may access messages for moderation and may block exchange of phone numbers or email addresses through messaging where necessary.

Listings and Transactions

  • Listing rules: Sellers are responsible for the accuracy of product descriptions, pricing, condition, images, shipping options, and delivery times.
  • Publication: Product listings are published automatically when created by sellers.
  • Shipping and pickup: Sellers may offer shipping or pickup. Buyers and sellers must coordinate shipping and pickup details. Table rate shipping and delivery time options may be available.
  • Fees: Sellers may pay fees for listing features such as featured stores, advertising, badges, or promoted placement. Fees are described in the seller dashboard or fee schedule.
  • Taxes: Sellers are responsible for collecting and remitting any applicable taxes. BuildersTogether may collect tax where required by law.

Payments, Payouts, and Holds

  • Payment processor: Payments are processed by Stripe. You agree to Stripe’s terms and privacy policy when using payment features.
  • Refund window and holds: Buyers have 30 days from delivery to request a refund. To ensure funds for potential refunds, funds may be held in our Stripe account for up to 30 days before vendor payouts.
  • Disputes and chargebacks: Disputes between buyers and sellers should be resolved through the marketplace. Chargebacks are handled according to Stripe’s procedures and BuildersTogether’s dispute policies.

Returns, Refunds, and RMA

  • Returns and refunds: Buyers may request returns or refunds in accordance with seller return policies and the platform’s buyer protection rules. Buyers have 30 days from delivery to request refunds.
  • RMA: Dokan RMA features may be used to manage returns, warranties, and exchanges. Sellers must comply with return and warranty requests in a timely manner.

Reviews, Ratings, and Content

  • User content: Listings, images, reviews, Q&A, and other content you post are your responsibility. You grant BuildersTogether a license to use, reproduce, and display content to operate the marketplace.
  • Reviews: Buyers may rate and review sellers and products. Reviews should be honest and not defamatory or fraudulent.
  • Moderation: We reserve the right to remove, edit, or refuse content that violates these Terms or our policies.

Intellectual Property

  • Ownership: BuildersTogether owns or licenses the platform, trademarks, logos, code, and content we provide. Users retain ownership of the content they create, subject to the license granted to BuildersTogether.
  • License to BuildersTogether: By posting content you grant BuildersTogether a worldwide, non-exclusive, royalty-free license to use, modify, reproduce, and display the content to provide and promote the Services.
  • Infringement claims: Notify us of claimed infringement by following the procedures in our DMCA and copyright policy.

Privacy and Data

Use of personal data is governed by our Privacy Policy. By using the Services you consent to collection, use, transfer, and storage of information as described in the Privacy Policy.

Disclaimers and Limitations of Liability

  • No warranty: The Services are provided “as is” and “as available” without warranties of any kind, except where prohibited by law.
  • Limitation of liability: To the maximum extent permitted by law, BuildersTogether and its affiliates are not liable for indirect, incidental, special, exemplary, or consequential damages, or loss of profits, revenue, data, or use, arising from or related to the Services.
  • Cap on damages: Where liability cannot be excluded, our aggregate liability to you for any claim related to the Services will be limited to the total amount of fees paid by you to BuildersTogether in the 12 months preceding the claim, or USD 100, whichever is greater.

Indemnification

You agree to indemnify and hold BuildersTogether, its officers, directors, employees, and agents harmless from any claims, liabilities, damages, losses, or expenses arising from your breach of these Terms, your listings, your use of the Services, or your violation of applicable laws.

Dispute Resolution and Governing Law

  • Governing law: These Terms are governed by the laws of the State of California, USA, without regard to conflict of law rules.
  • Dispute process: If a dispute arises, contact us to resolve the issue. If unresolved, disputes will be resolved through binding arbitration in Sacramento County, California, under the rules of the American Arbitration Association, unless you opt-out where permitted by law.
  • Small claims: You may bring qualifying claims in small claims court in Sacramento County if eligible.

Suspension, Termination, and Account Removal

We may suspend or terminate accounts or access to the Services for violations of these Terms, suspected fraud, illegal activity, or other conduct harmful to the platform. Termination does not relieve you of obligations incurred prior to termination.

Modifications to Services and Terms

We may modify or discontinue features, fees, or the Services at any time. We may update these Terms; we will post changes with a new effective date. Continued use after changes constitutes acceptance.

Third-Party Services and Links

The Services may include links to third-party websites, tools, or services (e.g., Google Maps, Stripe). We are not responsible for third-party practices, content, or policies. Your use of third-party services is subject to their terms.

Reporting Abuse and Policy Violations

Report abusive behavior, fraudulent listings, or safety concerns via our reporting tools or at builderstogetherbusiness@gmail.com. We will investigate and take appropriate action.

Notices

Notices to you may be provided via email, posted on the site, or through in-app messaging. Notices to BuildersTogether should be sent to builderstogetherbusiness@gmail.com or our business address: 2108 N St Ste N, Sacramento, CA 95816.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, Fee Schedule, and any other policies posted on the site, constitute the entire agreement between you and BuildersTogether with respect to the subject matter.
